The plainitiff ____hereby states that the Defendant Judge….unlawfully and without authority, and acting outside of the jurisdiction of his office and of the ____Court, ordered the confiscation of private property belonging to the plaintiff, and ordered that those funds which had been deposited with the Clerk of the ____court, be paid to the private attorney of ____as a fee for legal services performed for a third party _____.

The plaintiff deposited the sum of $____________, as a surety bond for the criminal defendant ____in Jefferson Circuit Court Action NO.__________, and that case has been concluded, and the plaintiff herein is entitled to have their bond released.

The court wrongfully ordered the Clerk to release said funds posted by the plaintiff to satisfy an award of attorneys fees the Defendant Judge made in favor of ______the attorney of said ______.

The plaintiff never authorized the Clerk or the Court to sieze these funds.

The plaintiff never guaranteed the legal fee of said ______________.(attorney)

The plaintiff never authorized the criminal defendant ______to act as his agent is authorizing the payment of the surety bond posted by plaintiff to any third party.

There is no law in Kentucky permitting a trial judge to award a private criminal attorney a legal fee.

There is no rule or law in Kentucky granting to a trial judge the jurisdiciton to seize money posted for a surety bond by a third person, and ordering that money to be paid to a private attorney.

The actions of the defendant judge exceeded his authority and jurisdiction and is therefore erroneous, and if allowed to stand will operate to inflict a grevious, immediate and irreparable harm to the plaintiff, and will operate to violate the constitutional rights of the plaintiff to be free of forfeiture of his personal property without due process of law.

The plaintiff seeks a Writ of Mandamus directing the Defendant Judge to:

1) vacate his order which seized the funds of the plaintiff

2) order the Defendant Judge to order the Clerk of the Jefferson Circuit Court to forthwith pay over to the plaintiff herein the amount of funds which the plaintiff had deposited as a surety bond in behalf of the criminal defendant ______

3) order the attorney ____________to return the money he was wrongfully paid by the Circuit Clerk, to the office of the _____Circuit Court.

In the alternative, the plaintiff seeks a Writ of Prohibition against said defendant judge if the context otherwise requires such relief in order to obtain the relief to which he is entitled.

How can I start a group home for adults or elderly and get paid through government?
These are great questions to ask. These days, millions of people need of quality housing but simply do not have the income to afford a place to live. With average rents at apartments of $1,109.73 in the second quarter of 2013, it is no wonder adults, and the elderly are looking for cheaper alternatives. Often, group homes for the elderly are the best options.

Homes like these often come with shared rooms, essentially giving two people the ability to live in a room together and inside a home with a common kitchen. In essence, they are roommates! Because this type of housing is in such high demand, many entrepreneurs and real estate investors are starting up group homes for adults and the elderly to make additional income. And in many cases, not just a little income. Often, the income potential can be astounding.

For specialized housing, an example being group homes for the developmentally disabled, owners such as the Levy brothers in New York each paid themselves over $1,000,000 per year. That equates to over $83,333 per month per person! And this was just the salary. Each brother had their company pay for luxury automobiles and tuition for their children according to the New York Times. With houses in the Hamptons, Sutton Place and Palm Beach Gardens; neither brother is hurting running group homes and special needs housing. And how do they do it? They run a Medicaid-financed organization serving the developmentally disabled according to the New York Times.

But these two brothers have also been doing this for quite some time. Let’s assume you are new to the industry or simply just looking for a way to make some additional money, provide an excellent service for others and quit your job. One of the questions you may ask is, “how do I collect rent” from the people I provide housing for? Do I get got to a tenant or does I always get paid through government?”

Options to Get Paid Through Government
Private Pay – The parents, relatives or the individual themselves pays for the monthly group home rent
Subsidized – SRO housing (HUD)
SSI – Supplemental Security Income payments are sent to the client via direct deposit onto their credit card or a physical check is sent out. Your client then pays the group home rent with this money
SSDI – Social security disability income is paid to your client. Your client then pays you directly
Access To Recovery Voucher – ACT vouchers can provide rental income for your recovery home, group home, elderly group home etc.
HHS – The United States Health and Human Services office has individual state offices throughout your neighborhood. They will pay for housing and related services so that your clients can pay you. The check comes directly from the HHS office.
Grants and many other locations – There are so many places whereby you are the owner of the group home can receive rent and obtain money for providing your services.

Stop Worrying About Collections
When it comes to running a group home for the elderly or any special needs population the most important thing to realize is that a small percentage of people will not have their rent money. However, the great thing about operating group homes for disadvantaged populations is not having to worry about collections! The money just shows up in your account because you can get paid through government.

How do you do this? Well, the most important thing to do is obtain the client. Once you have the client, his or her social worker, case worker or other care-taker will provide you with all the documentation you need to obtain the rent money that you charge for providing a quality and much needed service.

Breonna Taylor would have been 27 today

LHere’s where her case stands.

(CNN)On June 5, Breonna Taylor would have been 27 years old. But she was killed two months ago when police broke down the door to her apartment in an attempted drug sting, and shot her eight times.

A lot has happened since that day, and Taylor’s life and death have become folded into the larger worldwide outcry against police violence that exploded after the death of George Floyd in late May. Some worry the young black EMT, who was described as "full of life" and "a best friend to so many," is being forgotten.

Here’s where her case stands.

Legal: A wrongful death lawsuit, an FBI investigation, but no charges

Taylor’s family filed a wrongful death lawsuit two months after her killing, claiming charges of battery, wrongful death, excessive force, negligence and gross negligence. The no-knock warrant issued by police included Taylor’s house because, according to a police affidavit for a search warrant for the raid, which was obtained by CNN affiliate WAVE, authorities suspected a man involved in a drug ring was receiving packages of drugs at her home.

On May 21, the FBI’s Louisville office announced they were opening an investigation into the circumstances surrounding her death.

Since these legal announcements, there has been little movement in Taylor’s case. The three officers involved in her shooting are still on administrative leave, according to the Louisville Courier-Journal. But they have not been charged with any crimes.

Institutional: Changes to police department, exit of chief, outside review
On May 21, the Louisville Metropolitan Police Department announced it would require all sworn officers to wear body cameras. The LMPD also said it would change how the department carries out search warrants in response to Taylor’s death. Louisville Mayor Greg Fischer said the developments were the first steps the city would take toward improving police accountability

The same day, the LMPD’s Police Chief Steve Conrad announced he would be retiring at the end of June.

However, Conrad was removed from his post on June 1 after it was discovered the officers present at the shooting death of a black man named David McAtee during a Louisville protest did not have their body cams turned on.

On June 3, Fischer announced the city of Louisville would be "issuing a request for proposal for a comprehensive, top-to-bottom review" of the LMPD, to be conducted by an external firm. The request for proposal can be viewed here.

Social: Protests and current calls for justice

Taylor’s name has been a fixture in the recent protests spurred by the slaying of George Floyd , and some of the demonstrations have been specifically in her memory. During a protest in Louisville on May 26th featuring Taylor’s friends and family, demonstrators stood outside Mayor Greg Fischer’s house and demanded the arrest of the officers involved in her killing.

This demand has been echoed and amplified online. A Change.org petition calling for justice in Taylor’s death has been promoted by influential voices like singer Janelle Monae and Bernice King, and currently holds more than 3.5 million signatures.

Writer Cate Young has also called for several action items to be carried out on Taylor’s birthday, under the name #BirthdayForBreonna. They include signing the above petition, donating to legal aid funds or the GoFundMe campaign for Taylor’s family, and sending birthday cards to Kentucky’s Attorney General demanding charges in the case.

Finally, people are being encouraged to say Taylor’s name loudly and often; in the streets and online, so that in the deafening wave of dissent crashing over the country, her story is not washed away.
